Terms of Service for Stkrr

1. Acceptance of Terms

By downloading, installing, or using the Stkrr mobile application (“App”), you agree to be bound by these Terms of Service (“Agreement”). If you do not agree to these terms, do not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your iOS device for personal, non-commercial purposes. You may not: - Modify, translate, or create derivative works - Reverse engineer, decompile, or disassemble the App - Use the App for commercial purposes - Remove or alter copyright, trademark, or other proprietary notices

3. User Responsibilities

3.1 Account & Usage

• You are responsible for maintaining the confidentiality of your account
• You are responsible for all activities under your account
• You agree to use the App in compliance with all applicable laws

3.2 Acceptable Use

You agree NOT to: - Upload or generate stickers containing copyrighted material you don’t own - Create stickers intended to harass, defame, or harm others - Use stickers that violate anyone’s intellectual property rights - Attempt to bypass payment systems or free tier limits - Use the App for illegal purposes - Violate OpenAI’s usage policies

3.3 Content You Create

• You retain ownership of original photos you provide
• You grant us permission to use photos temporarily for processing only
• Generated stickers are your responsibility to use legally
• Do not share stickers that infringe copyright, violate privacy, or are harmful

4. Intellectual Property Rights

4.1 App Ownership

The App, including all code, graphics, interfaces, and design, is owned by Stkrr and protected by copyright and other intellectual property laws.

4.2 Generated Stickers

• Sticker artwork generated by the App is created using your photos and AI processing
• You own the generated stickers for personal use
• You may share stickers on social media or with friends
• We do not claim ownership of generated stickers

4.3 AI-Generated Content

• Generated stickers are created by AI based on your input
• OpenAI’s terms also apply to AI-generated content (see OpenAI’s Terms of Use)
• You are responsible for using generated content appropriately

5. Payments & Subscriptions

5.1 In-App Purchases

• Subscriptions are processed through Apple App Store
• You agree to Apple’s payment terms and conditions
• All prices are listed in your local App Store currency
• Prices may change with notice

5.2 Free Tier

• Free users can generate 3 stickers per calendar day
• Free users have access to 10 free sticker styles
• Premium subscribers have unlimited generations and all styles

5.3 Subscription Terms

• Weekly and Monthly subscription options are available
• Subscriptions automatically renew unless cancelled
• You will be charged 24 hours before renewal
• Cancel anytime in App Store Settings > Subscriptions

5.4 Refunds

• Refunds are handled by Apple App Store
• Request refunds through App Store settings or Apple Support
• We do not process refunds directly
• Apple’s standard refund policy applies

5.5 Price Changes

• We may change subscription prices with 30 days notice
• Existing subscribers keep their current price until next renewal
• You can cancel before renewal to avoid price increases

6. Disclaimer of Warranties

6.1 “As Is” Service

The App is provided “AS IS” without warranties of any kind. We do not guarantee: - Uninterrupted or error-free operation - Specific results or quality of generated stickers - Compatibility with all iOS versions or devices - Availability of the App (we may discontinue it)

6.2 Third-Party Services

• OpenAI API availability and performance are not guaranteed by us
• WhatsApp, iCloud, and other services operate independently
• We are not responsible for their downtime or changes

7. Limitation of Liability

7.1 No Liability For

We are not responsible for: - Loss of photos or data - Generated stickers being rejected by filters or policies - OpenAI API limitations or content policies - Suspension of WhatsApp or other third-party services - Any indirect, incidental, or consequential damages

7.2 Maximum Liability

Our total liability is limited to the amount you paid for the App (or $0 if you used the free tier).

8. Indemnification

You agree to defend and indemnify us from: - Any claims arising from your use of the App - Violations of these terms - Violations of third-party rights (copyright, privacy, etc.) - Generated stickers you create or share

9. Termination

9.1 Your Rights

You can stop using the App anytime by deleting it from your device.

9.2 Our Rights

We may terminate or suspend your access if you: - Violate these terms - Violate OpenAI’s usage policies - Use the App for illegal or harmful purposes - Attempt to bypass payment or free tier systems

9.3 Effect of Termination

• You lose access to premium features
• You retain your generated stickers on your device
• You forfeit any remaining subscription balance (Apple handles refunds)

10. Privacy

Your use of the App is governed by our Privacy Policy. Please review it:

11. Changes to Terms

We may update these terms at any time. Changes are effective when posted to the App or this document. Continued use of the App after changes means you accept the new terms.

12. Governing Law

These terms are governed by the laws of Qatar, without regard to conflicts of law principles.

13. Dispute Resolution

13.1 Informal Resolution

Before legal action, contact us to resolve disputes informally.

13.2 Legal Proceedings

• Any legal action must be brought within 1 year of the claim
• You agree to resolve disputes through binding arbitration
• Claims cannot be consolidated with other claims

14.1 OpenAI

Your use of AI features is governed by OpenAI’s Terms of Use (https://openai.com/terms)

14.2 Apple App Store

Your use of in-app purchases is governed by Apple’s App Store Terms of Service

14.3 WhatsApp

Sharing to WhatsApp is governed by WhatsApp’s Terms of Service

16. Severability
